ESOS Framework

About the ESOS Framework

The Australian Government wants international students to have a safe, enjoyable and rewarding study experience in Australia. Australia is one of the few countries to have enacted laws that ensure quality education and consumer protection for international students. These laws are known as the ESOS Framework and include the Education Services for Overseas Students (ESOS) Act 2000 and the National Code of Practice for Providers of Education and Training to Overseas Students 2018 (National Code 2018).

Key Legislation The ESOS Act 2000, the National Code 2018, and the Tuition Protection Service (TPS) together form the ESOS Framework that governs the delivery of education to international students studying in Australia on a student visa.

Ozford's Registration

The National Code 2018

The National Code 2018 provides nationally consistent standards for the conduct of registered providers and the registration of their courses. It sets specifications and procedures to ensure registered providers clearly understand and meet their obligations under the ESOS Act.

The National Code 2018 is made up of 11 Standards covering areas including:

  • Marketing information and practices
  • Recruitment of overseas students
  • Formalisation of enrolment
  • Education agents
  • Student support services and welfare
  • Transfers between registered providers
  • Student visa requirements and reporting
  • Deferring, suspending or cancelling enrolment
  • Feedback and Complaints processes

Tuition Protection Service

The Tuition Protection Service (TPS) is an initiative of the Australian Government to assist international students whose education providers are unable to fully deliver their course of study. The TPS ensures that international students are able to either:

  • Complete their studies in another course or with another education provider; or
  • Receive a refund of their unspent pre-paid tuition fees.

Your Rights as an International Student

Under the ESOS Framework, as an international student enrolled at Ozford you have the right to:

  • Receive current and accurate information about your course, fees and Ozford's services before and during enrolment.
  • Be provided with a written letter of offer prior to accepting enrolment, detailing fees, refund policies and your course information.
  • Access Ozford's internal and external feedback and complaints processes.
  • Know your rights in relation to refunds and the Tuition Protection Service.
  • Have your personal information managed and disclosed in accordance with Australian privacy law.
  • Access support services including welfare, academic support and counselling.

Your Responsibilities as an International Student

The ESOS Framework also supports the Migration Act by reinforcing students' responsibilities and conditions under their student visa. As an international student you are required to:

  • Understand and satisfy your student visa conditions at all times.
  • Maintain valid Overseas Student Health Cover (OSHC) for the duration of your stay in Australia.
  • Inform Ozford of any change of address or contact details within 7 days.
  • Maintain satisfactory course progress and attendance as required by Ozford's policies.
  • Complete your course within the expected duration as registered on CRICOS.
  • Adhere to any work conditions attached to your student visa.
  • Comply with all Ozford policies, procedures and the Student Code of Conduct.

Feedback and Complaints

Ozford has internal and external feedback and complaints processes in place as required under the National Code 2018. If you have a concern or complaint, you are encouraged to contact the Student Services team in the first instance.

If you are not satisfied with the outcome of an internal process, you have the right to access an external feedback and complaints process. Details are outlined in Ozford's Policies and Procedures.
